Terms of Service

01Acceptance of terms

These Terms of service form a legally binding agreement between you and AI Restaurants and govern access to the platform, including web applications, APIs, dashboards and automated messaging services.

By registering, accepting or using the platform, you confirm that you have read and accept these terms and our Privacy policy. If you act for a company, you confirm that you are authorized to bind it.

02Service description

AI Restaurants provides a SaaS loyalty and guest management platform for restaurants.

• Branded QR landing pages for guest capture
• Automated email campaigns
• Visit tracking, coupons and loyalty offers
• Owner and super-admin dashboards with analytics
• Location management for restaurant groups

03Account registration

• You must be at least 18 and legally able to enter contracts.
• Registration information must be accurate, complete and current.
• You must operate a food business or be authorized to act for one.
• You are responsible for account confidentiality and all activity under your account.

Report suspected unauthorized access to security@ai-restaurants.de.

04Subscriptions and billing

• Starter: EUR 0/month for one location and core features
• Growth: EUR 49/month for up to 5 locations and advanced campaign, coupon, menu and analytics features
• Multi-Location: custom pricing for unlimited locations and enhanced support

Paid plans are billed monthly in advance in EUR and renew automatically unless cancelled before renewal. We do not store payment card data.

05Acceptable use

• Do not send spam or contact guests without valid consent.
• Do not upload illegal, defamatory or infringing content.
• Do not perform unauthorized security testing, reverse engineering or resale.
• Do not use the platform for malware, phishing, scraping or infrastructure overload.

06Your content and data

You retain ownership of restaurant logos, offer descriptions, campaign text and other uploaded content. You grant AI Restaurants a limited license to host, display and transmit that content as needed to provide the service.

We do not use your content or guest data to train machine-learning models.

07Guest data and messaging

• You are generally controller for your guests’ personal data.
• Marketing messages may only be sent to guests with valid, voluntary and informed consent.
• Unsubscribe and deletion requests must be honored promptly and within legal deadlines.
• A current privacy notice for guests must be accessible.

08Intellectual property

The AI Restaurants platform, software, designs, brands and documentation are owned by AI Restaurants and protected by intellectual property laws. We may use feedback without compensation to improve the platform.

09Service availability

We aim for 99.5% monthly platform availability, excluding scheduled maintenance. Interruptions caused by events outside our reasonable control, including internet infrastructure or third-party provider outages, are excluded.

10Liability

To the maximum extent allowed by law, we are not liable for indirect, incidental, special, consequential or punitive damages. Our total liability for claims under these terms is limited to the fees paid in the 12 months before the claim. Liability that cannot legally be excluded is unaffected.

11Indemnity

You agree to indemnify AI Restaurants for claims, losses, damages and reasonable costs arising from unlawful use, infringement of third-party rights, privacy-law violations or content you provide through the platform.

12Termination

You may cancel your subscription in account settings. We may suspend or terminate accounts for breaches, fraud, illegal activity, court orders or unresolved payment failures.

13Governing law

These terms are governed by European Union law and the law of the jurisdiction where AI Restaurants is registered. We recommend first trying to resolve disputes informally. EU consumers may also use the European Commission online dispute resolution platform.

14Changes

We may update these terms. For material changes, we will notify account holders at least 14 days before they take effect and may require renewed acceptance.
